The fact that some people are willing to buy a copy for £3.99 and not pay anything at all on top of that for the audiobook version doesn't change the fact that this is not theft. If you make a copy of a book from a publisher you're not a member of, and distribute that without paying taxes on it, that's theft. If you don't pay taxes on the audiobook you bought, that's theft. If you download the audiobook file and burn it to a CD, that's not theft. Even if it's someone else's book, you are not stealing from them; you are getting the book for free as a gift, and you're giving the gift to someone else who paid for the audiobook file.
But if you're in the UK, and you want the audiobook file format, it would still not be theft, as you're not benefiting from any copyright violation. Downloading the audiobook file from the US and burning it to a CD for personal use is not theft. The author is still paying the taxes on the production of the book, and the author still has to pay the taxes on the recording, and the author still has to pay the taxes on the writing, and so on. If you're willing to pay for the actual costs of the production, you don't have to pay taxes on the product -- which means in practice, that if you live in a country where it's possible to buy the book, and you're willing to buy the book, you can ignore the taxes on the book. (In the UK, you can easily buy a book at Amazon without entering any personal details, which makes it particularly easy to decide not to pay the VAT.)
If you're from the UK, you're fully within your rights to rip the audiobook files from an American audiobook (one which is licensed to your country) and burn them to CD. If you're from the UK and you're willing to buy the audiobook file from an American audiobook (one which is licensed to your country) and burn it to CD, that's entirely legal. If you're the UK government, and you want to change the laws to make the law explicitly allow the UK to rip audiobooks from American audiobooks and burn them to CD, that'd be perfectly reasonable.
The books are not free to download, they are free to burn to CD or transfer to a computer. Free in the sense that I do not need to pay for the download. For the most part, the books are not available to download in the USA.
